Standard Terms and Conditions of Service, version 2026-10
These Data Processing Terms are referred to in the Mecha AI Standard Terms and Conditions of Service effective October 15, 2026 (version 2026-10), available at www.gomecha.ai/terms/terms-10152026 (the “Terms”). Capitalized terms have the meanings given in the Terms.
C1 Scope. These Data Processing Terms apply, under Section 17.1 of the Terms, only where a state privacy law requires a contract between the Client and Mecha AI as its processor or service provider, and only to personal information in Client Data that the law covers. Where they apply, Mecha AI acts as the Client’s processor or service provider, and these Data Processing Terms control over the Terms to the extent that law requires.
C2 Instructions, Nature and Purpose. The Client’s instructions are the Agreement and the Client’s configuration and use of the Services. The nature of the processing is collecting, recording, transcribing, analyzing, storing and transmitting calls, messages and Contact Data. The purpose of the processing is providing the Services and creating the data described in Section 11.3(d) of the Terms.
C3 Data and Data Subjects. The data processed are Contact Data, Call Records, Message Records, and Recordings. The data subjects are Contacts and the Client’s personnel.
C4 Duration. The duration of processing is the Term, plus any retention under Section 8.4 of the Terms.
C5 Confidentiality. Each person who processes the data is subject to a duty of confidentiality.
C6 Delete or Return. At the end of the Services, at the Client’s written direction, Mecha AI deletes or returns the personal information, except as the law requires or Section 8.4 of the Terms permits.
C7 Information and Assessments. Mecha AI makes available information reasonably necessary to show compliance with these Data Processing Terms. It allows a reasonable assessment by the Client or its designated assessor, at the Client’s expense, no more than once in any twelve months, on thirty days’ notice. Alternatively, Mecha AI may provide a report of an independent assessment.
C8 Subcontractors. Mecha AI uses Providers and other subcontractors under written contracts and identifies them on request. The Client may object to a subcontractor by written notice; its remedy is to terminate the affected SOW without the Early Termination Fee.
C9 Assistance. Taking into account the nature of the processing, Mecha AI gives reasonable assistance with consumer rights requests and data protection assessments that the law requires of the Client.
C10 California. Where the California Consumer Privacy Act (the “CCPA”) applies, Mecha AI: will not sell or share the personal information; will not retain, use or disclose it for any purpose other than the business purposes in C2, or outside the direct business relationship; will not combine it with personal information from other sources except as the CCPA permits; will comply with the CCPA and give the same level of protection; and will notify the Client if it can no longer meet these obligations. The Client may take reasonable and appropriate steps to stop and remediate unauthorized use.
C11 Breach. Section 17.5 of the Terms applies.
